This summary is a convenience. The full terms below are what apply.

1. Who we are and what this covers

Cackle ("the Service," "we," "us") is operated by Midwest Capital Solutions, a company based in the United States. These Terms of Use ("Terms") govern your use of the Cackle website and games, including joining a room, hosting a room, and viewing a room on a shared screen. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy and Safety page are part of these Terms.

2. Eligibility: 13 or older

You must be at least 13 years old to host or join a room. If you are under 18, make sure a parent or guardian is OK with you using the Service. We do not independently verify your age. If we learn that someone under 13 is using the Service, we may remove them and delete related data.

You are responsible for making sure that everyone you invite to a room you host is old enough to play, and that using the Service is lawful where you are.

3. No accounts, and how you join

You do not need an account. You pick a display name when you join a room. Your device stores an anonymous identifier so you can reconnect to the same room if your connection drops. You are responsible for what happens on your device while you are in a room.

3a. Mobile apps and app stores

If you get Cackle through the Apple App Store or Google Play, these Terms are between you and Midwest Capital Solutions, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app, and are not responsible for any claims about it, including product liability, legal compliance, or intellectual property claims. If the app fails to meet a legal warranty, you may notify the store, which may refund any purchase price, and to the extent allowed by law the store has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms for the iOS app and may enforce them against you. You confirm that you are not located in a country subject to a U.S. embargo and are not on a U.S. list of prohibited parties. The app may ask for camera access to scan join QR codes, as described in our Privacy Policy.

User-generated content. Players can see content other players create. Players must accept these Terms to play. We filter content, and you can report objectionable content or users, and hosts can remove players. See Safety. We act on reports promptly.

4. Hosts

The person who creates a room is the host. Hosts can choose game settings and can remove ("kick") players from the room. Hosts must not use the Service to pressure, dare, or require anyone to do anything unsafe or that makes them uncomfortable. See Safety for details.

5. Acceptable use

When you use the Service, you agree that you will not:

We run an automated content filter on the server that checks names, answers, and other text for slurs, explicit content, and personal information. It is not perfect. Text that is blocked may not appear, and filtering does not mean that we endorse or have reviewed what players write. You can find out how to report a problem on the Safety page.

6. Your content and the license you give us

"Your content" means the display names, answers, votes, drawings, and any other material you submit while playing. You keep whatever rights you have in your content. By submitting it, you give Midwest Capital Solutions a limited, non-exclusive, worldwide, royalty-free license to host, transmit, process, and display your content to the other people in the room, on the host's screen, and on players' phones, solely so we can run the game. This includes any results or recap screens shown during that session.

Rooms and their content are automatically deleted about 5 hours after the last activity. We do not keep your content after the room expires, and we do not use it for advertising or sell it. Because people in the room can see your content, and anyone can take a screenshot or record a screen, we cannot control what other people do with what they see. Do not submit anything you would not want the room to see.

You promise that you have the right to submit your content and that it does not break these Terms or the law. If the Service later offers a share card or recap image, anything you choose to save or share from it is your own choice and responsibility.

7. Safety and dares

Cackle is a party game, and some cards ask players to do things. Dares are optional: nobody is required to do anything, and anyone can pass. Do not do anything dangerous or that could damage property. Do not leave the room or the building to complete a task. Look out for each other.

You are responsible for your own choices and for following the laws where you live. We are not responsible for any injury, damage, or harm connected to a game session. See Safety for help resources.

8. Our intellectual property

The Service, including the Cackle name and logo, game names, game modes, prompts and other content we provide, designs, code, sounds, and look and feel, belongs to Midwest Capital Solutions or its licensors and is protected by intellectual property laws. We give you a limited, personal, non-transferable, revocable permission to use the Service as intended. You may not copy, sell, or create derivative works from our content or code, or use our names and branding in a way that suggests we endorse you, without our written permission.

Other names and trademarks mentioned belong to their respective owners, and we are not affiliated with them. If you believe content on the Service infringes your rights, contact us using the details in section 16 and include enough information for us to find and assess it.

9. Paid features (future)

Cackle is free today. We may add optional paid features later, which would be processed on the web by a payment provider such as Stripe. If we do, we will show the price and the terms of the purchase before you pay, and we will update these Terms and our Privacy Policy as needed. Unless a purchase screen says otherwise, or the law requires it, payments are not refundable.

10. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, secure, or error-free, that rooms will not disconnect, or that the content filter will catch everything. Some places do not allow certain disclaimers, so some of this may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, Midwest Capital Solutions and its owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service, including anything another player says, draws, or does. To the fullest extent the law allows, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim (which may be zero) or US$50. Some places do not allow these limits, so they may not apply to you in full.

12. Your responsibility

You agree to be responsible for your own content and conduct. To the extent the law allows, you will cover claims, losses, and reasonable costs that arise from your violation of these Terms or the law, or from content you submit.

13. Termination

You can stop using the Service at any time. We can remove content, remove a player or room, or suspend or block access (including by device or network address) at any time, with or without notice, if we think you have broken these Terms, put others at risk, or abused the Service. Hosts can also remove players from their own room. Sections that by their nature should survive termination (including content license limits, intellectual property, disclaimers, limits of liability, and governing law) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of [STATE TBD BY FOUNDER], United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in [COUNTY/STATE TBD BY FOUNDER], and you and we consent to that jurisdiction, unless the law where you live gives you the right to bring a claim elsewhere. Please contact us first at the address below so we can try to sort it out.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top. Changes apply going forward. If you keep using the Service after a change, you accept the new Terms. If a change is significant, we will try to make it visible on the site.
